Suspended police officer Tariq Bhanot, an accused in the Sadiq Jamal fake encounter case, today sought bail before a CBI court saying Jamal's custody was given to Gujarat-cadre IPS official D G Vanzara and not his client before the killing took place in 2003.

"According to an affidavit filed by a former Mumbai- based journalist Ketan Tirodkar, Jamal's custody was given to a 'man with a beard' who was a Gujarat-cadre police officer, which indicated that Jamal's custody was given to Vanzara and certainly not to Barot, by a Mumbai police official," Barot's advocate Dilip Bhatt argued before Special CBI Judge P C Raval.

Barot, a suspended Deputy Superintendent of Police, had moved his bail plea before the special court here last month and contended that the probe agency filed its charge sheet in the encounter case on December 21, 2012.

However, the prosecution in the court has not been progressing and Barot has been in jail for more than two years for no reason, the bail application said.

Today, CBI opposed his bail plea and submitted that he was involved in the conspiracy relating to the fake encounter.

"The accused cop was involved in the conspiracy about which the prosecution agency has given ample evidence," advocate L D Tiwari told the court, arguing for CBI.
