According to the company, the Apex Court has further ordered that the 12 SEZ units, which are currently operating can continue to operate. The court has also directed Union Ministry for Environment and Forest (MoEF) to process APSEZ’s application for environmental clearance within 30 days, as directed by the Gujarat High Court.
On January 13, a division bench of Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala had held that APSEZ violated environmental guidelines by allotting land to individual units in the absence of the mandatory green clearance under the Environment Impact Assessment (EIA) Notification, 2006.
The court ordered closure of the 12 units in the premises of the SEZ, as they had violated its earlier order of May 2012, where it had stayed construction and further development activities by units including the Adani owned units of the APSEZ.
