BSES says Tata Power overruled regulatory order

 BSES fired yet another salvo before the state regulator, the Maharashtra Electricity Regulatory Commission, alleging that TPC's decision to supply power to certain customers located in the Girikunj Industrial area at Andheri, a western suburb in Mumbai, amounted to a contempt of the commission's order of July 3, 2003.  In this order, the commission had restrained TPC from supplying power to customers below 1,000 kva.  TPC has, however, contended in its petition that its consumer is Girikunj Industrial Premises Co-operative Society, whose maximum demand is 1,250 kva.  Consequently, the connection given to it does not constitute a violation of the commission's orders.  A senior TPC executive told Business Standard, "We have clarified that this does not amount to contempt of the commission's order."  TPC and BSES have been feuding on this issue for quite sometime now. Under the terms of the power distribution licence issued to TPC, it has been largely supplying to bulk customers.  However, over the last few years it has been attempting to supply power to retail customer which BSES claims that TPC is not allowed to.  MERC has clarified that TPC is restrained from supplying power to customers below 1,000 kva only for the time being.
