The Delhi High Court has upheld the right of Godrej Sara Lee to advertise the virtues of its mosquito repellent cream marketed under the Good Knight brand.
In a judgement dated December 4, the Delhi High Court dismissed the interim application of Dabur, makers of the Odomos brand of mosquito repellent cream, saying that the former’s attempts to bring out the virtues of its product did not constitute disparagement.
Dabur had moved the Delhi High Court on October 20 this year, seeking a stay on the ad released by Godrej for its mosquito repellent cream, which it said portrayed other creams as causing rashes and allergy and not being skin-friendly. Good Knight with natural ingredients, on the other hand, was made out to be safe on the skin, Dabur had said in its application before the court. But the court, after hearing both sides, upheld the right of Godrej to extol the virtues of its product.
