With the intervention of Delhi High Court, a former employee of J K Industries, who was terminated from service in 1977, has got his 14 months salary from the private company after three decades.
Setting aside a single judge’s order dismissing a petition of Avineshwar Sawhney, a Division Bench headed by Justice A K Sikri also directed the company to pay amount on the basis of Rs 3,425 per month for the period with an interest of 6 per cent per annum to Sawhney.
In his petition, Sawhney said he had entered into a contract with the tyres and tubes division of J K Industries to work as a production manager in 1975. The salary was also fixed for Rs 3,425 per month.
The company had sent him to the US for training in the same year. After his return from the US in 1977, the company terminated his service on the ground that it had lost its confidence in the employee.
Agggrieved with the termination order, Sawhney approached the court saying that as per the contract signed between him and the company, his service was to complete in 1981.
However, the company had terminated him in 1977, which was wrongful termination.
Claiming the salary for the period of September 1977 to 1981 and other consequential benefits, the petitioner filed a case before the single judge. The judge rejected the petition and upheld the company’s order.
