Madras HC issues notice to Ran India Steels, IPAB

The Madras High Court issued a notice to Ran India Steels (P) and the Intellectual Property Appellate Board (IPAB) today after an Uttar Pradesh -based company filed a petition alleging infringement of its trademark.

Uttar Pradesh-based Rana Steels India Limited filed the petition challenging the IPAB's dismissal of its petition seeking to strike down the registration of a trademark, 'RANATOR', by Ran India Steels (P)  of Tamil Nadu. Rana Steels alleged that the trademark was deceptively similar to its own 'RANA' trademark.

Rana Steels asked the court to call for IPAB's records and quash its 'impugned' order dated October 22 last year so that the trademark granted to the Tamil Nadu firm could be cancelled.

It was pleaded that the impugned registration was contrary to all the provisions and was against the interests of the market and consumers.

Based on the petition, a division bench comprising Chief Justice M Y Eqbal and Justice T S Sivagnanam issued notices to Ran India Steels (P) and the IPAB. The High Court bench also posted the matter for hearing after two weeks.
