RCom plea seeking clarification on TDSAT order dismissed

Telecom tribunal TDSAT today dismissed a petition by Anil Ambani group firm Reliance Communications (RCom) seeking a clarification on its judgment on allocation of additional spectrum and dual technology regime.

In its application, RCom, which has been allocated a start-up spectrum of 4.4 Mhz in all circles for GSM services, sought clarification that the TDSAT order is not a bar on geeting 6.2 MHz of spectrum.

"Clarify that judgement dated March 31, 2009 does not bar the allocation of spectrum of 6.2 MHz to those who have got 4.4 MHz," said RCom in its petition.

TDSAT Chairman Justice Arun Kumar observed that RCom in its petition has submitted that "there was neither an issue, nor any discussion nor any finding by this tribunal relating to the allocation of licence mandated and contracted spectrum upto 6.2 MHz. It is further submitted that this tribunal has not given any finding relating to the issue..."

Noticing the sharp contrast in RCom stand in the prayer and its application, the TDSAT said, "In view of this stand of the applicant itself, this application is not maintainable."
