Gujarat High Court today reserved order on a plea seeking implementation of the no-confidence motion passed by majority members of Gujarat Cooperative Milk Marketing Federation (GCMMF) against incumbent chairman Vipul Chaudhary.
Justice Paresh Upadhyay reserved the order on plea filed by GCMMF seeking permission as per Supreme Court order, to implement the no-confidence motion against Chaudhary. The today completed hearing after recording arguments of both the parties. The verdict is likely to be pronounced in the first week of January 2014.
The documents regarding the no-confidence motion was place before the court as per the directions of the Supreme court early this month while hearing the plea of Chaudhary challenging the no-confidence motion.
As many as 13 out of 16 voting members voted in favour of the no-confidence motion against Chaudhary on December 5 during board meeting of GCMMF. The members have alleged that the no-trust motion was brought because they were suspicious of Chaudhary's functioning and suspected that his way of administration was not in interest of the federation. They further said that motion was need to safeguard the interest of three million milk producers of Gujarat.
The board of directors had got the green signal on December 4 from a division bench of Gujarat High Court to discuss the no-confidence motion against Chaudhary. On one hand GCMMF chief approached the Apex Court against the order of a division bench of Gujarat High Court allowing the members of the federation to discuss no-confidence motion, while on other hand the members passed the no trust motion against him
The Supreme Court however, refused to interfere with the no-confidence motion passed by the federation members against Chaudhary and disposed of his plea with direction to the member dairy unions to approach the single judge in Gujarat High Court to decide on implementation of the no-resolution motion.
Govt submits inquiry report on Mehsana dairy union
The state government on Friday submitted in Gujarat High Court an inquiry report on the allegation of corruption against Gujarat Cooperative Milk Marketing Federation (GCMMF) chairman Vipul Chaudhary with regard to his role in Mehsana District Milk Producers Union Ltd (MDMPUL), which is also headed by him. The report was submitted in a sealed cover to division bench of Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala. The court had last week order the state government to submit report in sealed cover while hearing a petition challenging probe ordered into allegations of corruption made by some of the Mehsana Union members. In their public interest litigation (PIL), the petitioners have alleged that there has been large-scale corruption at various levels by the MDMPUL chairman Vipul Chaudhary and his close aides. The petitioners have alleged that misappropriation in production of cattle feed by Mehsana Union has resulted in loss of Rs 200 crore to the union. They have further claimed that Mehsana union was charging more for cattle feed from members.
