FIR filed against minister for delivering hate speech and alleged violation of model of code of conduct in Belgaum

A case has been filed against Maharashtra Home Minister R R Patil and Deputy Chief Minister of Karnataka K S Eshwarappa for alleged violation of model of code of conduct. These two leaders had made “provocative speeches” and the Election Commission has asked the deputy commissioners of Belgaum and Shimoga districts for a report on Patil and Eshwarappa respectively.

An FIR has been filed against Patil by the police for delivering an alleged hate speech on Belgaum issue, a bone of contention between the two states. Patil has also been booked under the Representation of People Act for violation of the election code of conduct for the May 5 assembly poll in the state.

Anil Kumar Jha, chief electoral officer, Karnataka, said the commission would act based on the reports from the deputy commissioners.

Patil, in his speech delivered in Belgaum on Sunday to celebrate the birthday of Kiran Thakur, leader of the Maharashtra Ekikaran Samithi (MES) and editor of Marathi daily Tarun Bharat, had allegedly made some provocative remarks.

The FIR has been registered under Sections 153(A) of IPC for provoking and creating disharmony between communities on basis of religion, race, place or birth or language and under the Representation of People Act, police said.

Belgaum and some other border areas have been a bone of contention between Maharashtra and Karnataka. Maharashtra claims Belgaum should be a part of it, while Karnataka maintains that it is part of the state.

Jha said, 84 candidates have filed their nominations for the May 5 polls in Karnataka on the second day of filing nominations on Friday. With this, 111 nominations have been filed for the elections in two days. On April 10, 27 nominations were filed. The Election Commission will upload their affidavits within a few hours, he said.

None of the sitting MLAs or ministers has filed nominations on Friday. Varthur Prakash, independent MLA and minister had filed his nomination on April 10. Mysore and Kolar have topped the list with nine nominations each, while BBMP Central and Bidar have seen eight nominations each.

He said the commission has received 1.73 million applications for inclusion in the voters’ list and so far 1.12 million applications have been approved.

Jha said, the Commission has received a notice from the Central Administrative Tribunal (CAT) for transferring former commissioner of police, Jyotiprakash Mirji and several other IAS officers. Mirji had approached CAT challenging his transfer. “We will study the notice and submit our reply on the next hearing posted on April 17,” Jha said.

Mirji, in his plea, contended that the ECs directive states that the transfer was made for conducting “free and fair elections” and such a remark made without any basis casts stigma on his career.
