PIL seeks court to direct govt to take over BCCI

A Public Interest Litigation (PIL) was filed with the Madurai bench of Madras High Court on Wednesday seeking direction to the government to take over the control of Board of Control for Cricket in India (BCCI) and to bring in a central agency for investigation of the ongoing spot-fixing, betting scam related to the Indian Premier League (IPL).

The court has issued notice to nine parties, including the sports ministry, BCCI president N Srinivasan, IPL president Rajiv Shukla, Delhi and Mumbai police commissioners, among others, according to Peter Ramesh Kumar, counsel appeared for the petitioner. The next hearing is scheduled on June 10, 2013.

The petition, filed by Madurai-based lawyer V Santhakumaresan, alleged that certain activities and receipt of income of the BCCI has no element of charity. Kumar said that BCCI is registered as a Charitable Trust and it should not be claimed as Indian Cricket Team.

While all the other sports are controlled by government organisations, the controlling authority of cricket in the nation is a private charitable trust and the sport should be taken over by the government, he added.

The petition sought the Court to direct a central investigating agency like Central Bureau of Investigation (CBI) to take over the investigation of the current IPL spot fixing, match fixing scandal, as people from several states are involved in it and has alleged links overseas.

The order to serve notice was issued by Justice M M Sundresh and Justice R Mala, asking the respondents to file counters within the stipulated time.
