The CBI, which had filed the closure report in September 2007 in the case involving Congress leader Jagdish Tytler, on Thursday raised the issue of court's jurisdiction to decide on the issue. A jampacked court room was stunned by the submission of CBI counsel when he questioned the jurisdiction of the Additional Chief Metropolitan Magistrate’s court to take a decision on the closure report.
The CBI contended that the court had no jurisdiction because the case related to murder and rioting and should be adjudicated by a Sessions Court. The agency maintained silence and refused to answer any media queries as to why the CBI did not raise the jurisdiction issue when the chargesheet was filed in June 2006 and a closure report in September 2007. The CBI’s closure report in September 2007 was shot down by the same court.
