The Delhi High Court has granted a permanent injunction in favour of Hindustan Pencils. The court has restrained Champion Corporation from using the colour scheme, get up and lay-out on its carton that was similar to that of Plasto erasers as well as the trade mark, Plasto.
Champion Corporation had given an undertaking not to use the carton that was similar to that of Hindustan Pencils as well as the trade mark Plasto.
Hindustan Pencils uses the trade mark Nataraj Plasto 621 for its erasers with a distinctive colour scheme and get-up on its carton. A picture of a woman and a boy also appears on the carton. The slogans,
