Gujarat HC quashes DP World's plea

In a setback to Dubai Ports World (DPW), the Gujarat High Court, in an operative order yesterday, dismissed a writ petition by the company challenging the state's maritime regulator Gujarat Maritime Board's (GMB's) decision to terminate its sub-concession agreement to run Mundra International Container Terminal (MICT) at the Adani group's Mundra port.
 
The maritime regulator had said DP World stood disqualified to operate MICT because it took holdings of the container facility without taking its prior permission. The GMB claimed that P&O could not transfer assets and property to DP World without its consent and that no "change of control" of MICT could be permitted.
 
Ganesh Raj, senior vice-president and managing director of DP World (Subcontinent Region), told Business Standard in response to an e-mailed query that "It is incorrect that the Gujarat High Court upheld any decision of the GMB. Only the operative part of the order was pronounced on January 7, 2008. We understand from what was pronounced on January 7 that the petition is not maintainable under writ jurisdiction."
 
"The company is awaiting a formal written order copy to pursue its next step. We will exhaust all legal options to protect our interests and investment," he said when asked if the company would move the Supreme Court. He said DP World would not alter its plans in India.
