Gujarat to allow city peripheral agri land for industrial use

In a major relief to industry, Gujarat government is gearing up allow industrial development within 5 kilometers of any city.

The state government has set the ball rolling to remove section 65B of Bombay Land Revenue Code, 1879, so that investors could use land in 5 kms periphery of the area falling under the jurisdiction of any Area Development Authority or Urban Development Authority.

Under the existing provision of section 65B of Bombay Land Revenue Code, any occupant of the land, which is used or held for agriculture or for any non-agriculture purpose, is allowed to use the land for bonafide industrial purposes other than manufacture or storage of any chemical or petrochemical without the permission of the collector.

However, if such land falls within 5 kms of the area within jurisdiction of any area development authority or urban development authority, the owner is required to get a clearance of the collector to use the land for bonafide industrial purposes.

The decision to move a Bill aimed at removing section 65B of the existing act was taken after taking numerous representations from investors.

The proposed amendment will enable the investors to use peripheral land for industrial purpose without the permission of the collector subject certain conditions, which include that such land must be having title clearance, the land or the part of it is not shown as reserved for public purpose in draft or final development plan and town planning.

Gujarat government is bringing a Bill The Bombay Land Revenue (Gujarat Amendment) Bill, 2008 during the ensuing monsoon session of the state assembly.

With this, the agriculture land within 5 kms radius of the jurisdiction of area development authority or urban development authority would easily get Non Agricultural (NA) status, so that such land could be used for industrial purposes.
