Hathway submits undertaking over signal pilferage

Rahejas-controlled multi system operator (MSO) Hathway Cables today submitted an undertaking before the Telecom Dispute Settlement and Appellate Tribunal (TDSAT) over pilferage of signals of cricket telecaster Neo Sports from its network.
 
The undertaking has come following the direction of the TDSAT to settle the matter.
 
Yesterday, TDSAT Chairman Justice Arun Kumar had directed both the companies to "work out some amicable solution" and to report today.
 
According to the undertaking, Hathway would confine Neo's signals only to Conditional Access System (CAS) notified areas.
 
If Neo finds that the signals were pirated in the non-CAS areas, then upon receiving such information Hathway would disconnect the signal of the local cable operator within one hour, according to the undertaking by the MSO.
 
Sports telecaster Neo has two channels Neo Sports, for cricket, and Neo Sports Plus, for other sports.
 
Hathway had approached the TDSAT seeking restorations of signals of Neo Sports Plus. It had also said there was a constant disruption in the signals of Neo Sports.
 
The telecaster had also served disconnection notice for Neo Sports to the MSO.
 
The MSO contended the disconnection was hampering its business as only Neo Sports had the exclusive telecast rights of the ongoing test series between India and South Africa.
 
Justifying its stand, Neo contended that it had an agreement with the MSO only for telecasting the signals in CAS notified areas.
 
However, Neo found that the cable operators associated with Hathway were showing the feed of the matches in non-CAS areas also.
 
In another case filed by Bhaskar Multinet seeking stay on the disconnection notice sent by Neo Sports, the TDSAT directed the MSO to follow the terms and conditions.
 
Bhaskar alleged that ignoring all the laws and regulation Neo was disrupting their signals. Justice Kumar also ticked off Neo Sports saying "you are the sole broadcaster having rights... and whenever match starts you use such arm tactics".
 
On this, Neo submitted that Bhaskar did not properly declare its subscriber base. The MSO was paying for more subscribers to another sports channel ESPN Sports, it said.
