The Allahabad High Court has ruled that eligible government employees with a bright career should not be deprived of promotional avenues.
"The denial of promotional avenues with the intention to adjust others shall have demoralising effect on the government employee", a division bench comprising Justices Devi Prasad Singh and Bala Krishna Narain of the Lucknow bench of the high court said.
The bench passed the judgement yesterday on a writ petition of Dr Raksha Goswami challenging her removal from the post of Director Ayurveda and her appointment as Director Syllabus and Evaluation, which she said was an insignificant post.
The court directed the state government to permit and restore the petitioner to the post of Director Ayurveda forthwith with all consequential benifits.
It also imposed costs of rupees one lakh on the state government directing it to deposit the amount in the high court within a month, out of which Rs 50,000 will be remitted to Mediation Centre Lucknow and the remaining Rs 50,000 to the petitioner.
The court also quashed the order dated October 29 2009, by which the petitioner was appointed as Director Syllabus and Evaluation.
