HC slams illegal operation of power crushers in UP

The Allahabad High Court has restrained the illegal operation of power crushers and ‘kolhu’ in reserved and assigned cane areas of Uttar Pradesh.

The HC passed the order on a writ petition filed by the Venus Sugar Limited, Moradabad. However, the court noted the order will not be operative in respect of unassigned and surplus sugarcane of the reserved and assigned cane area.The court further issued mandates to the cane cooperative societies to ensure supply of all the allocated cane to the petitioner.

The mandate has also been issued for the mill to ensure timely payment of cane price and the society commission to cane growers and societies respectively, and to lift the entire offered/bonded cane to the extent of 85 per cent as per the bonding policy.

The order was passed by a bench presided over by Justice Amitava Lala.

The mill’s counsel contended the petitioner was not able to get sufficient cane due to power crushers and ‘kolhu’ operating in reserved and assigned cane area without licence.
