The National Consumer Disputes Redressal Commission (NCDRC) has upheld a lower fora order, directing a tractor company and its dealer to pay compensation of Rs 50,000 to a woman for failing to rectify the manufacturing defect in the vehicle.
The Bihar State Commission had ordered the Indo and Form Tractors and Tractors Limited and its dealer, Nanhakoo Shah, to either replace the defective vehicle or pay cost of the tractor to the consumer with a compensation of Rs 50,000.
"Facts show that the tractor delivered to the consumer had developed snags," the Commission, comprising members B N P Singh and S K Naik, said, holding that the mechanic report shows even if some parts would be replaced, there would not be significant improvement.
The tractor was purchased by one Vidhayawati Devi, a resident of Bihar, in 2004 but it soon developed problems which could not be rectified by the company.
The report from the mechanic deputed for the purpose was controverted by petitioner Shah, saying that it was prepared under threat and coercion but the fora below did not find any merit in the contention, the apex consumer fora observed.
Shah, aggrieved by the state commission's order, approached the NCDRC but he failed to convince the Commission which also ordered him to pay Rs 5,000 as costs to the consumer.
