The Supreme Court today refused to allow automobile company TVS Motor to go ahead with the booking of its 125cc bike 'TVS Flame' till the Madras High Court hears a patent case filed by its rival Bajaj Auto Ltd (BAL). |
A bench headed by Justice S H Kapadia dismissed the TVS Motor's plea seeking modification in January 18 order of the Supreme Court restraining it from taking further bookings for the two-wheeler till January 29. |
In an application, TVS Motor had requested for being allowed to book the vehicles and had promised not to deliver them till the High Court decides on the matter. |
The bench issued the direction on a petition filed by BAL challenging the Madras High Court's December 20 order allowing TVS Motor to go ahead with the manufacturing and selling of 'TVS Flame' bikes. |
The apex court also directed to maintain the status quo and asked the High Court to hear the matter on January 29. |
Bajaj Auto had accused TVS Motor of infringing its patent on DTS-i (Digital Twin Spark Plug ignition) technology for TVS Flame. |
TVS, in its latest 125 cc motorcycle Flame, uses CCVTi technology. Bajaj claims this to be a copy of its DTS-i technology, which is used in various products including its best-selling Pulsar models. |
TVS, however, has denied BAL's allegations and has slapped a Rs 250-crore defamation suit against the Pune-based company. |
