SC stays Gujarat HC order on illegal structures

In a swift and surprise action, the central government today moved the Supreme Court and got a stay on the Gujarat High Court order asking authorities to remove illegal constructions.
 
Additional Solicitor General Gopal Subramaniam appeared before a Bench headed by Justice Ruma Pal during "mentioning time" and submitted that the high court order was passed on the basis of a newspaper report and without verification of facts.
 
Subramaniam, quoting a home ministry report, said situation in Vadodara was tense after violence following demolition of a dargah and the Army has staged a flag march in the riot-affected areas.
 
The court issued notice to the state government and other parties in the case. But no date has been given for the next hearing and the court is closing for vacation next Friday.
 
The high court had directed the authorities to remove all religious structures encroaching upon public spaces across the state. According to the news report, the list would include 1,200 temples and 260 Islamic shrines.
 
The high court had pulled up the Ahmedabad Municipal Corporation and the Ahmedabad Urban Development Authority for being "silent spectators" regarding encroachments on public places by religious structures.
 
Meanwhile, curfew was relaxed for two hours for women and children in Panigate, Karlibaug and Raopura areas of the city where violence has left six persons dead.
 
In Vadi, covering about 50 police station areas, and Navapura, curfew was relaxed for women and children between 2.30 pm and 4.30 pm, Police Commissioner Deepak Swarup said.
 
The Army will conduct a flag march for the second consecutive day today between five and seven in the evening in the disturbed areas of the city, he added.
 
Swarup said at a meeting attended by the municipal commissioner, mayor, representatives of both the communities and himself yesterday, it was decided that no religious structure would be demolished without consultations with members of the community concerned.
 
Swarup said the police were working in a neutral manner but action had to be taken against those indulging in violence.
