Court stays privatisation move till Nov 28

In the backdrop of record hike in sugarcane State Advised Price (SAP) for the 2008-09 crushing season, the Allahabad High Court on Monday extended the stay on the privatisation of 33 Uttar Pradesh Sugar Corporation mills till November 28, 2008.

Hearing a Public Interest Litigation (PIL) filed by Rajeev Kumar Mishra of Maharajganj district, a division bench comprising Justices Ashok Bhushan and Vinit Saran adjourned the hearing till November 28.

As per the order, the third party right shall not be created till the next date of hearing.

Both the petitioner and the state government counsel had sought adjournment on Monday.

The PIL had contended that the divestment move of the UP government was against several central and state laws.

On October 13, Mishra had filed the amended petition challenging the September 29, 2008 Ordinance by UP in respect of the sale of the equity share of the sugar mills, which he claims was meant to legalise the illegal sale.
