Bombay HC sets aside Maggi ban, orders fresh tests

Ordering fresh tests on Maggi noodles, the Bombay High Court on Thursday set aside the ban on the popular instant snack.

The court's verdict will provide partial relief to Nestle India, which has destroyed tonnes of the instant snack.

"Nestle will be allowed to sell its products after a period of six weeks from the time when these laboratories conduct a fresh test. And these laboratories would be the accredited laboratories which have been set out in the order. Only those laboratories will be conducting the test," said lawyer A M Sethna.

"This appears to be a conditional lifting order, subject to the conditions which were imposed by the Honourable court," he added.

The Department of Consumer Affairs, Ministry of Consumer Affairs, Food and Public Distribution had yesterday filed a complaint under Section 12(1) (d) of the Consumer Protection Act, 1986 in the National Consumer Disputes Redressal Commission (NCDRC).

The department filed the class action suit on behalf of the large number of consumers of Maggi in the country against Nestle India on grounds of unfair trade practices, sale of defective goods and sale of Maggi Oats Noodles to the public without product approval.

The complainant has sought a sum of Rs. 2,84, 55,00,000 that the opponent company is liable to pay and a sum of Rs. 3,55,40,70,000 as punitive damages on account of the gross negligence, apathy and callousness on the part of the opponent company. The total claim is for a sum of Rs. 6,39,95,70,000.
