A special CBI judge has convicted former municipal councilor of Delhi Hiren Tokas and Subhash Chander Jain in connection with a bribery case.
Tokas was sentenced today to five years rigorous imprisonment and asked to pay a fine of Rs.25,000 while Subhash Chander Jain was sentenced to a year's rigorous imprisonment and asked to pay a fine of Rs.5,000.
A case was registered by the CBI on April 9, 2003 against Tokas under Section 9 of the PC Act, 1988, on the basis of a complaint. It was alleged that Tokas had demanded a bribe of Rs. 1 lakh to avoid the demolition of the complainant's shop.
On repeated requests, the said bribe amount was reduced to Rs.50,000 by Tokas. The CBI laid a trap and Tokas was caught red handed while demanding and accepting a bribe of Rs.20,000 as first installment from the complainant.
After completion of investigation, the chargesheet was filed on September 11, 2004 before the Special Judge for CBI Cases under section 120-B of IPC and 7 and 13(1)(d) r/w 13(2) of P.C. Act 1988 and substantive offences against Tokas and Jain, a resident of Palam Colony, New Delhi.
The trial court found both guilty and convicted them.
