A court on Wednesday dismissed the bail plea of Puneet Kumar, accused of fleeing to India in 2009 after his car hit and killed an Australian student and injured another.
Lawyer of Kumar, Harinath Ram, said that they were not satisfied with the court's ruling and would move the application in High Court.
"We had moved the bail application for Puneet's bail and the bail application was heard today by the court and bail application was dismissed. We are not satisfied with the order of the court and we are planning to move the honourable high court against the order of the bail applications," said Ram.
Kumar was charged by Victoria Police for causing death of 19-year-old Dean Hofstee and seriously injuring 20-year-old Clancy Coker in a road accident that happened in 2008. Both victims were students from Queensland.
Police then said alcohol levels in Kumar's blood showed he was inebriated and estimated that he was driving at a speed of 92 miles per hour at the time of the accident.
Last year in December, Kumar was produced before a court in Rajpura district in Punjab, where he said he wanted the trial to continue in India as his life was under threat in Australia.

Resonating his words, Puneet's father, Naresh Kumar said that Australia had adopted a policy of racism and after being attacked several times in that country, the police there had done nothing to defend his son.
"His case should proceed in a court in India only. We have full faith in the judicial system of India and we do not trust the judicial system of Australia at all because there is a policy of racism," said Naresh Kumar outside the court.
After being arrested in India, following a widespread manhunt by the Victorian and Indian police, Interpol plans to push for his extradition to Australia in the Delhi court, according to a police statement.
Puneet was arrested on November 29, 2013 after a five-year-long manhunt.
Puneet had gone to Australia to study hospitality. He fled the country in 2009 using a friend's passport after he was found guilty of negligent driving, local media reported.
