The Arvind Kejriwal government has declared that it will table the Jan Lokpal Bill in the Delhi assembly today, ignoring Union Law Ministry's view that the Centre's prior approval is required.
The Union Law Ministry has held that the rules governing Delhi government's legislative business were constitutional where Centre's consent was required before its passage.
The Law Ministry has held that the Transaction of Business Rules (TBR) make it mandatory that the Lt Governor refer to the Centre every legislative proposal which may necessitate additional financial assistance.
Kejriwal had on Sunday said that he would resign from the Chief Ministership of Delhi if the Jan Lokpal Bill is not passed in the Delhi Assembly.
"If the bill is not passed then I have no wish to continue as the chief minister. I can sacrifice the chair of a chief minister 100 times to wipe out corruption from this country. To establish Swaraj in the country I can sacrifice the chair 1000 times. I haven"t come here to become a chief minister; I have come here to clean corruption from this country," Kejriwal had said.
The hardening of the AAP government's stand came even as Congress and BJP held the move unconstitutional.
Reacting to Kejriwal's threat to resign, Delhi Congress Chief Arvinder Singh Lovely had earlier said that if the Aam Aadmi Party (AAP) really wants the bill to be passed they should do it in accord with the constitution.
