Looks like Kelly Rutherford is taking the custody battle for her kids too far as the actress has now refused to return her kids to Monaco, despite a court order that requires her to do so.
Tabloid media revealed that the 46-year-old actress is not obeying the orders of a Monaco court, which gave her former husband Daniel Giersch the custody of their children three years ago, reported TMZ.com.
Making a legal argument about the jurisdiction in her custody battle, the 'Gossip Girl' star said that no state in the country currently requires her to send her children away and that's why she has decided that she cannot lawfully send her children away from the United States to live in a foreign country.
Rutherford added that she believes Monaco appreciates why it cannot assert jurisdiction over her children and that Monaco will respect her children's right to reside in their own country.
Giersch, however, has not spoken up on the issue.
