Macchil fake encounter: Army to court martial colonel, major, four others

The Army has decided to court martial six soldiers, including two officers who were found accused in the Macchil fake encounter case.

A decision to this effect was taken after recording of summary of evidence.

In May, the army was given custody of Territorial Army personnel Abas Hussein Shah by the police. Soon after taking Shah into custody, the army started recording the Summary of Evidence in the case that was conducted by a senior army commander.

Officials said that on basis of the report of summary of evidence, the army decided to court martial its men against whom cases had been registered by the police.

Earlier, the army had completed a court of inquiry that was headed by commander 68 Mountain Brigade, Brigadier G.S. Sangah.

"The case against the accused army men is very tight and they (army men and officials) will have to face the consequences as the police has produced strong evidence in the case against the accused army men," said a prosecutor privy to the case.

The prosecutor said that after summary of evidence, in which the officials recorded statements of the soldiers of the unit, family members of the deceased youth and the police officials and the accused army personnel it was decided to court martial the accused army men.

He said then that since the commanding officer of the unit was also an accused in the case, the court martial proceedings would be headed either by an officer of the rank of Brigadier or Major General.

Soon after the killing of three youths, police had produced charge sheet against a colonel, two majors, five soldiers and three civilians.

Last year, the Army had moved an application in the Chief Judicial Magistrate Court, Sopore, opting for a court martial of its troops involved in the Macchil fake encounter case and had sought the custody of rifle man Abas Shah.
