Oz woman asking for compensation for sex accident at work loses claim

A public servant from Canberra, who got injured in a "vigorous" sex session in a country motel six years ago, has lost the case against the federal government for workers' compensation.

The High Court ruled out that she was not entitled to compensation from the federal workplace insurer Comcare as the circumstances of her injury were unrelated to her employment.

Comcare lawyers had argued that she should not get taxpayer-funded compensation because of her "personal choice" to have sex while on the work trip, Stuff.co.nz reported.

But the woman's lawyer argued the public service, having sent the lady to the NSW country town, was liable for her welfare, even if she got injured while having sex.

The bureaucrat suffered lacerations to her nose and mouth as well as "psychological injuries" when a glass light fitting was pulled from the wall of the motel room as she had sex with a local man in Nowra in November 2007.
