SC orders Indian doctor in US to be compensated with nearly 6 cr. for AMRI medical negligence

The Supreme Court on Thursday ordered that Dr. Kunal Saha, who is based in Ohio, be compensated with a record amount of nearly six crores within eight weeks, after his deceased wife was badly diagnosed and overdosed on steroids by Advanced Medicare and Research Institute (AMRI) in Kolkata in 1998.

Dr. Saha's wife, Anuradha, contracted toxic epidermal necrolysis while in India and was misdiagnosed during her trip to Kolkata in 1998.

Earlier today, the apex court ordered three doctors, who attended to the deceased to collectively pay Rs. 25 lakhs of the compensation.

The judges also said that the entire amount of 5 crores and 96 lakhs has to be given to Dr Saha within eight weeks.

In 2009, the Supreme Court agreed to the charges of gross negligence levelled by Dr. Saha against AMRI and its doctors.

The Supreme Court had asked the National Consumer Disputes Redressal Commission to determine the amount of compensation, and the consumer court settled on 1.7 crores, but Dr. Saha had appealed against the ruling.
