The NHRC on Thursday reiterated that the Delhi government should pay Rs.1 lakh as compensation to a minor sexually assaulted by an employee of a government hospital in 2013.
The National Human Rights Commission (NHRC) had in January 2015 directed the Aam Aadmi Party (AAP) government to compensate the 15-year-old.
The Delhi government argued that the onus of providing relief should lie on the accused.
"It was established that a minor girl was raped at the hospital by a staff who was a public servant. It amounted to violation of human rights of the girl, for which the state is vicariously liable," the commission said.
"The commission, as per Section 18 (a) (i) of the Protection of Human Rights Act, 1993, can recommend the concerned government to compensate the complainant. Therefore, the commission reiterated its earlier stand for payment of monetary relief to the victim."
The NHRC asked the government to submit a compliance report along with the proof of payment within six weeks.
