A court here acquitted a man, accused of attempt to commit culpable homicide, after the advocate appearing for the complainant in the case accused his own client of filing a false case for making money.
Additional Sessions Judge Savita Rao while acquitting east Delhi's resident Amit Chaudhary, facing trial under various charges including attempt to commit culpable homicide, noted that an application was moved by counsel of the complainant seeking withdrawal of his submission during final argument of the case.
The counsel has alleged that complainant Rajiv Deo had forced the counsel to move application for cancellation of bail of accused since the accused was not willing to pay Rs.5 lakh for settlement and the complainant wanted the counsel to assist him in recovery of Rs.5 lakh from the accused for hushing up the matter.
The counsel told court that he came to know that the complainant and his brother Ranjan Deo were habitual complainants filing false cases with the sole aim of making money.
The advocate added that complainant made false call to the police that counsel and his associates were threatening him after he turned down their demand.
"The allegations contained in application are serious, copy of which has already been sent to Bar Council for appropriate inquiry and action, as required, and though this court is under obligation not to be swayed away by the allegations made in application in pursuance to some disagreement between the complainant and his counsel," the court said.
Meanwhile, the court let off Chaudhary in the case observing that complainant and his brother recorded their statement three days after the incident despite being medically fit.
