The Delhi High Court Tuesday issued notice to the city police on the bail plea of a rape accused who claims to be a juvenile.
Justice Mukta Gupta sought a response from Delhi Police and status report on the plea of the accused who said he was falsely implicated in the case of rape and charged under POCSO (Protection of Children from Sexual Offences) act. The FIR claimed that the victim was a minor at the time of the incident; however the accused said the victim was an adult.
The plea said that he and the victim were in a relationship but her parents were against it, so they implicated him in a false case. He and the victim had a consensual physical relationship but the victim's parents gave it the colour of rape, the accused alleged.
He annexed the school certificate of the victim according to which her age was 20 years at the time of the incident. However, as per the prosecution, her age was 14 years.
According to the ossification test, the accused's age came out between 17 to 19 years.
The plea said the trial court dismissed his bail plea March 21 saying the allegations against him are serious. Despite being a minor, he has been in jail for almost three and a half months.
