Court rejects Jharkhand plea to drop case against BJP MLA

A court in Dhanbad on Thursday rejected a plea by the Jharkhand government to withdraw a criminal case lodged against BJP legislator Dhullu Mahto on charges of freeing an accused from the police lock-up.

The government had decided to withdraw the case against the legislator and after completing the formalities moved the Dhanbad district court, seeking to drop the case.

The court rejected the plea as trial is going on.

According to the police complaint, Mahto forcibly took away an accused from the police lock-up on May 12, 2013.

The legislator later surrendered and was in custody for more than six months. He is now out on bail.

The state government initiated the process six months ago and finally gave its approval this week to drop the case against him.

This was the second time an act of the Jharkhand government was overruled by a court.

The government had slapped charges under the Crime Control Act on former minister and Congress leader Yogendra Sao, but a high court committee last month rejected the move.
