Delhi court convicts married man for raping woman

A court here has convicted a married man for raping a woman in 2008 after posing as a bachelor and giving her a false promise of marriage.

Additional Sessions Judge Virender Bhat Wednesday held Chanderhas Yadav guilty of rape.

"I hold that the prosecution has been successful in establishing that the accused had represented falsely to the prosecutrix (woman) all along that he is a bachelor and would marry her and had taken her consent for sexual intercourse on the false promise of marriage as he, being already married, knew that he could not marry her," the court said.

"He also knew that the prosecutrix (woman) is under the firm belief that he is a bachelor and would marry her and it is for this reason she consented to have sexual relations with him," it observed.

The court further added that the consent of the woman to the physical relations with Yadav is not a free and voluntary consent.

According to prosecution, the woman knew Yadav since five years.

Yadav disclosed in November, 2013 that he is married and refused to marry the woman. Following this, the victim filed a complaint against Yadav in Dabri police station in west Delhi.

Police arrested Yadav Nov 29, 2013.

The court will deliver its sentence next week.
