Delhi HC misled by Chief Secretary: Rakhi Birla

The Delhi High Court's disapproval of contempt proceedings by the state Assembly against the Chief Secretary was because it was misled into believing "fallacious contentions" in the case, the Deputy Speaker said on Tuesday.

"Regrettably, the High Court was misled into believing all the fallacious contentions of the Chief Secretary (M.M. Kutty) to be true before passing such an order," Rakhi Birla said in a statement.

The remarks came a day after the court stayed the effect and operation of the October 6 show cause notice and October 13 meeting notice issued to Kutty by the Question and Reference Committee of the Assembly for not following its direction to incorporate adverse remarks in the annual confidential report of an IAS officer.

"The Chief Secretary was untruthful when he purposely hid all facts in the matter from the court," said Birla, who is also the chairman of the committee.

"He did not bring to the notice of the court the fact that he was asked to present the status of the action taken by him on the recommendation of the committee dated May 18, 2017."

The court's order came on an application by Kutty seeking to stay the operation of notices and restrain the respondents from initiating any contempt or breach of privilege proceedings against him during the pendency of his petition.
