Delhi Medical Council's response sought on doctor indicted for sexual offence

The Delhi High Court on Monday sought response from the Delhi Medical Council (DMC) and an Indian doctor, who was indicted of sexual battery for unwarranted medical examinations on women patients by a US court in 2011.

Acting Chief Justice Gita Mittal and Justice C. Hari Shankar issued notice to DMC and the doctor and sought their response by May 23, the next date of hearing.

The doctor was barred from professional practice by a US court, saying he deserves to be barred from practising in India as well.

Earlier, the court, taking suo moto cognisance of media report that a doctor who was barred from professional practice by a US court in 2011 is seeing patients in Gurugram and Delhi, initiated an enquiry on him.

The bench took into note a media report as per which in 2010 the doctor had pleaded guilty to three counts of sexual battery for unwarranted medical examinations on women patients.

After negotiations in plea-bargaining before a court in Georgia, the doctor was permitted to leave the US upon surrendering his United States Medical Licence and was not allowed to practice medicine in any form within the US or any other country, said the news report.

Sanjeev Jain, Member Secretary of Delhi State Legal Services Authority (DSLSA), who was asked to enquire about the doctor, told it that he has been practicing and running clinic in Delhi and Gurugram.
