FIR against party MLAs is a conspiracy: AAP

A day after a FIR was lodged against three of its MLAs on charges of assaulting a woman, the AAP on Friday said that Delhi Police has no jurisdiction to register a FIR on any incident within the Delhi Assembly premises and termed the action as a "conspiracy" against them.

Aam Aadmi Party (AAP) spokesperson Saurabh Bharadwaj said that according to The Government of National Capital Territory of Delhi Act, Delhi Assembly, its committees and members enjoy the same privileges as the Lok Sabha and police has to take permission from the Speaker of the House before taking action against any of its members.

In the AAP's case, Bharadwaj said the police illegally registered the FIR even without taking permission from the assembly Speaker. "Police has no jurisdiction to register FIR on any matter happened within the assembly premises but still they registered the complaint against the AAP legislators."

He said with this move Delhi Police has shown it's dual character as the same police had denied registering a complaint last year, when an AAP councillor Rajesh Kumar was beaten up in a mock session of civic bodies at Ramlila Maidan.

"Police had then cited necessity to take the nod from the Mayor but here they don't take permission from the Speaker. This FIR is a conspiracy against the AAP leaders," Bharadwaj said.

Bharadwaj added that Simranjit Kaur Bedi -- who registered a complaint against three AAP MLAs -- was provided entry on June 28 on the recommendation from the office of Leader of Opposition Vijender Gupta even when he was not in the country and did not attend the session.

"How Gupta's office recommended for providing pass to the woman saying she was coming to meet Gupta, knowing that he is not in the country?" the AAP leader asked, adding that this sequence of events "points towards a conspiracy".

Police filed the FIR on Thursday against three AAP legislators on charges of assaulting a woman in the Delhi Assembly premises last week, after she filed a complaint against them.

According to police, Bedi alleged in her complaint to Civil Line Police Station that AAP MLAs Jarnail Singh, Amanatullah Khan and Somnath Bharti confined her in a room (within the assembly premises) and abused and manhandled her.
