10 yrs imprisonment to man for possessing over 84 kg ganja

A Delhi court has awarded 10 years rigorous imprisonment to a man for possessing over 84 kgs of banned drugs in 2012.
Additional Sessions Judge Narinder Kumar handed down the jail term to Bihar resident Shanker Shaney, who was carrying over 84 kgs of ganja in violation of provisions of the Narcotic Drugs and Psychotropic Substances (NDPS) Act.
"...Convict is hereby sentenced to rigorous imprisonment for ten years and to pay fine of Rs one lakh," the court said.
The court, however, acquitted two other co-accused, Dalip Sahney and Bhiku Sahney, saying the police has failed to prove their case against them.

"...This court finds that prosecution has established its case that Shanker, when apprehended on March 23, 2012 in front of police station Kamla Market, kept in his possession 84 kilograms and 800 grams of ganja in violation of provisions of the Act.
"As regards, Bhiku and Dalip, in view of the above findings that prosecution has failed to establish its case against both of them, they are acquitted of the charge framed against them," the court said.

According to police, Shanker was arrested from Kamla Nagar area on March 23, 2012 on a secret information that he would be carrying 84 kgs and 800 gms ganja in a hired tempo.

Later on, at his instance, Dalip and Bhiku were arrested from Gopal Pur village here.
The police, however, could not arrest other co-accused Ravinder Chaudhary and he was declared proclaimed offender.
The court had framed charges against Dalip, Shanker and Bhiku on March 12, 2013 for the offences under the provisions of the NDPS Act.
During the trial, the three arrested accused claimed they were falsely implicated in the case.
