24-yr-old accident victim's parents get Rs 8 L compensation

The parents of a 24-year-old man, who was killed in a road accident involving a rashly driven tempo in Gurugram in 2012, have been awarded a compensation of Rs eight lakh by a motor accident claims tribunal (MACT) here.
MACT presidingofficer Vidya Prakash asked Oriental Insurance Company, the insurer of the tempo, to pay Rs 8.06 lakh to the parents of Haryana resident Parveen Kumar.
"In view of the evidence which has come on record, it is held that the petitioners (parents) have been able to prove on the basis of preponderance of probabilities that Kumar had sustained fatal injuries in road accident which took place on November 22, 2012 on flyover of IFFCO Chowk at Sector18 of Gurugram in Haryana due to rash and negligent driving of a tempo...," the tribunal observed.
The petition by Kumar's parents said that the bike he was riding was hit from behind by a tempo driven in a rash and negligent manner and without following traffic rules.
It said that Kumar, who was working as a project engineer with a fire safety firm, was taken to a nearby hospital but succumbed to injuries two days later.
The tribunal noted that the insurance company has not filed anything to show that any term or condition of insurance policy was breached or violated by the insured.
The driver and the owner of the company failed to file any defence in the matter.
The tribunal rejected the contention of the insurance company that the witness statement was recorded after considerable delay, saying plausible explanation has been filed in the matter.
