Additional Sessions Judge Illa Rawat awarded the rigorous jail term to Abdul Razzak, a resident of Jahangir Puri here, saying though his act does not call for leniency, considering his age, a lenient view is taken in the matter.
The court directed the Delhi Government to pay Rs one lakh compensation to the child for her welfare and rehabilitation under the 'Restorative and Compensatory Justice' scheme.
"I am of the considered opinion that the prosecution has successfully proved that the accused attempted to commit rape upon the victim child, a minor girl, and as such prosecution has succeeded in proving the guilt of accused Razaak on the face of record, beyond the reasonable doubts," the judge said.
According to the prosecution, the incident took place in January last year when the child's parents had gone for work and she was out fetching water from a public tap.
The moment the door was opened, the child ran away and disclosed the incident to her mother. Razzak was caught by the neighbour and police was called.
