ABAM urges J'khand govt not to implement Land Acquisition Act

Akhil Bharatiya Adivasi Mahasabha (ABAM), a tribal organisation, today urged the Jharkhand government not to implement the Land Acquisition Act in scheduled areas.
In a letter to the Director of Revenue and Land Reform department of Jharkhand today, ABAM vice-president Mukesh Birua said the constitutional provisions, particularly under the Schedule Area and Panchayat (extension to schedule area) Act,1996 protected the fundamental right of the tribal community.
As the government was the custodian and trustee of the immovable property of the tribal community, they could not be displaced from areas where their places of religious, social, cultural importance existed.
Any move to displace them from their land would be in violation of section 29(1) of the Constitution as well as section 50(7) of the Chotanagpur Tenancy Act, Birua claimed.
Mere compensation against displacement cannot address the actual problems faced by the community on account of their lifestyle and ethos, he added.
