The Bombay High Court today directed social activist Mohammed Kasim Khan, whose sting operation led to suspension of 36 police personnel as they were shown allegedly accepting bribe, to submit the video recording device for analysis to Forensic Science Laboratory.
A division bench of Chief Justice Mohit Shah and Justice M S Sanklecha said the device should be handed over to R R Mavle, assistant director at FSL who will be "personally liable" for its safe custody.
"The device and storage chip shall be kept in his (Mavle) safe custody and not be given to any other other officer. If anything happens to the original device, then this officer will go to jail. He should not later say that some other officer asked to see the tape and so on," the court stated.
The forensic lab at Kalina here shall analyse the device and submit its report in a sealed cover within a month to the petitioner and the state Anti Corruption Bureau(ACB) which has registered FIR against the 36 police personnel from Nehru Nagar police station in suburban Kurla.
The court has also directed the petitioner to appear before the ACB within a fortnight to record his statement and give his voice sample.
Khan's sting operation conducted in April this year showed police personnel accepting bribe for allowing an illegal construction in the area.
Khan in his petition before the high court has sought forming of a Special Investigation Team to probe the case.
