The Calcutta High Court today cancelled the bail of five accused in the murder of All India Gorkha League president Madan Tamang allegedly by Gorkha Janmukti Morcha supporters at Darjeeling town in May 2010.
A division bench comprising Justice Nishita Mhatre and Justice Kanchan Chakraborti cancelled the bail of the five accused who had been granted bail by the Darjeeling district court.
Tamang's widow moved an application for cancellation of bail of the five accused claiming that they had obtained bail by resorting to unfair means.
The division bench, while cancelling the bail of the five -- Kismat Chettri, Keshab Pokhrel, Dinesh Gurung, Uran Thamvi and Alok K Churung -- directed them to surrender within 14 days.
Tamang, a widely respected leader in the Darjeeling hills was stabbed to death while making arrangements for a public meeting at Chowkbazar near the Mall in Darjeeling town on May 21, 2010.
Of the 31 persons named in the FIR, nine persons had been arrested while the main accused Nicole Tamang had fled from CID custody.
Of the nine, four were granted bail by the high court earlier.
The remaining five accused received bail from the Darjeeling court without mentioning that the CBI was then handling the case and had not made them party in the application, the petitioner claimed in the high court.
