Bangladeshi national gets life term in dacoity-cum-murder case

A Delhi court has awarded life imprisonment to a Bangladeshi national, who along with other dacoits had killed a man after he resisted their dacoity bid in 2013.
District and Sessions Judge P S Teji handed down the jail term to Badshah, a native of Bangladesh, for killing 32-year- old Animesh Datta, an east Delhi resident, while committing dacoity at his house along with six-seven other youths armed with knives and choppers. His accomplices have not been arrested yet.
The court also imposed a fine of Rs 40,000 on him with a direction that the amount be paid to Animesh's parents, Sumer Datta and Prabha, who had been tied down by the dacoits and were the eye-witnesses to the incident.
"Testimony of complainant (Sumer) and his wife, who are the eye witnesses/victims, is quite natural and trustworthy. They remained stuck to their stand that it was accused who along with his associates committed dacoity in their house and also committed murder of their son while committing dacoity.
"In view of unshaken statements made by the victims, I am of the firm view that statements of victims of the crime who happened to be eye witnesses of the incident and had suffered at the hands of the accused, are sufficient to base conviction if their solitary testimony inspires confidence of the court," the judge said.
The court also relied on the post mortem report of Animesh, which revealed that he died "due to strangulation and smothering".

It noted that the articles robbed during dacoity were recovered at the instance of Badshah.
He was held guilty of the offences punishable under section 120B(criminal conspiracy) read with section 395 (dacoity) of IPC, under sections 396 (dacoity with murder) and 412 (dishonestly receiving property stolen in the commission of a dacoity)of the IPC.
The court also found him guilty under the Foreigners Act for residing in India without any valid visa or documents of stay.
