The Commission also directed the Home department to make payment within two months.
The two brothers, Mohammad Shamsad Alam and Mohammad Irshad, residents of Sitamarhi district, were charged for allegedly taking 17 children (6-13 yrs) to Maharashtra for child labour. The case was later found to be false.
"It is, therefore, prima facie established that the petitioner Md Shamsad Alam and Md Irshad had to remain in jail for six months due to improper submission of charge-sheet on 07.10.2014," Commission member Neelmani said.
Alam had complained to the Commission that he and his brother were falsely implicated, arrested and detained in Runnisaidpur police station of Sitamarhi district on August 8, 2014 under sections of IPC such as 363 (punishment for kidnapping) and 370 (buying or disposing of any person as a slave) and various sections of other Acts including Justice Juvenile Act, Bonded Labour Act and Child Act.
The case, after investigation, was found false. The petitioner and his brother had to remain in jail for six months, the rights panel said.
