The PIL alleges that the office occupies 4,000 sq feet of area, and not all of it is authorised.
After BJP's lawyer S U Kamdar stated the party was ready to reduce the space to 1,200 sq feet, the bench headed by Justice Abhay Oka said it would pass an order tomorrow.
BJP is currently heading the coalition government in Maharashtra.
"Anything not permissible under the law must go," Aney had said, while maintaining that allotment of the land to the party was lawful and the entire office could not be said to be illegal.
Petitioner 'Nariman Point Churchgate Citizens Welfare Trust' alleges that there exists no sanctioned plan of the office building, which was supposed to be a temporary structure but was turned into a permanent one.
