Bangalore Metropolitan Task Force police had last month served a notice on Ashoka, who also holds Home portfolio, to depose before them as a witness over the allegedly illegal allotment.
The notice was served on Ashoka for reportedly allotting the land in Somanahalli village under Uttarahalli Hobli of Bangalore South constituency to the couple in 2004.
Ashoka had given the land to them that year in his capacity as MLA of Padmanabhanagar constituency and also as head of the Bagair Hukum Land Grant Committee.
In June this year, a Sub Divisional Magistrate cancelled the allotment owing to a false declaration that the couple were landless labourers. The woman also did not reveal she was married to Murty.
She said she was the daughter of one Kenchappa and had not applied the land for herself but for her grandmother who was into farming.
On August 15, an English daily published the "false claims" following which Venkatesh Murthy found fault with Ashoka, stating he was instrumental in allotting the land.

Based on this information, BMTF police registered a case against the couple and served notices on Asoka to appear before them in person to clarify why they had given a false declaration.
Since Ashoka did not turn up, the BMTF registered a case against him.
