N B Bharathi had challenged the order relieving her from the Intelligence Bureau on November 27 and directing her to report to Director General of Police, Odisha, after availing admissible joining time.
Bharathi contended that she was promoted twice while on deputation and was therefore entitled to continue for five years -- till January 15, 2014.
She also said her latest Performance Appraisal Report had ranked her as 'outstanding' and that she was transferred to Bangalore only in November 2009.
She said she could not relocate her 10 year-old son who was in the last quarter of the academic year.
Bharathi said she has been transferred now without any reason and relieved from IB, giving only a couple of days to relocate her son and herself.
She contended that not only was she entitled to a five year tenure, but additionally to two months leave when relieved from deputation.

Justice K B Suresh, Vice-Chairman of CAT, granted a 14- day stay and posted the matter for December 18 after hearing Bharathi's counsel Navkesh Batra.
"Prima facie the case seems to have been established by her in view of the Apex Court ruling regarding mid session transfer...The balance of convenience seems to be in her favour," the judge said.
"Therefore, notwithstanding the relieving order, which is hereby stayed, she shall be retained in Bangalore for a period of 14 days from today," CAT stated in its order.
