The CBI source told PTI tonight that charges against Bose, who had been granted bail earlier in the day under Section 420 of IPC, is not tenable since he had been slapped with charges under Sections 409 of IPC as well.
"We had issued summons against him both under Sections 409 and 420 of IPC. But under Section 409 there are still days left to file charge sheet against him. We will definitely challenge it in higher court once we get the certified order of the copy," the source said.
District and Session Judge's Court, Alipore Samaresh Prasad Chowdhury granted bail to Bose after imposing three conditions that he would not leave the country, he would not threaten witnesses and he would respond to CBI's summons, whenever served.
