CCI closes case against Hyundai Company, three dealers

The Competition Commission has closed a case against auto maker Hyundai Motor Company and three dealers as it did not find sufficient evidence to prove cartelisation.
It was alleged that car maker Hyundai Company and its authorised dealers --Nimbus Motors, Himgiri Car Pvt Ltd and Pawan Auto Wheels Pvt Ltd-- have contravened the provisions of the Competition Act in respect to provision of car maintenance and repairing services.
In a complaint filed by Samundra Sain, owner of a Hyundai i10 model car manufactured by Hyundai, said that the conduct of the four entities to refuse internal report, impose arbitrary charges, hide the deficiency in services and to refuse to repair the car in spite of knowing the fault in the engine were all done in collusion with each other.

The Commission Commission of India (CCI), in an order dated May 19, said that the matter is related to deficiency in services provided by Himgiri Car and Pawan Auto Wheels in repairing the engine of the car owned by an individual. Therefore, "the subject matter of the present information does not fall within the domain of the competition law".
The fair trade regulator also said the individual has made some "vague allegations" of collusion against all the four entities but there is nothing on record to substantiate such allegations.
"The Commission finds that no, prima facie, case is made out against the Opposite Parties (four entities). Therefore, the case deserves to be closed down," it said.
